General Terms and Conditions (GTC) Hoch-Ybrig AG
1. General
The General Terms and Conditions (GTC) apply to all sercices and products of Hoch-Ybrig AG.
2. Tickets and subscriptions
2.1 Validity
All tickets and subscriptions are personal and non-transferable. They are only valid during the published operating hours.
2.2 Loss and Theft
In the event of loss or theft of a ticket or season ticket, a single replacement will be paid upon presentation of the purchase receipt. A processing fee of CHF 25.00 will be charged for the issue of the replacement ticket.
2.3 Abuse/Counterfeiting
All tickets are automatically checked at the turnstiles. Visual inspections are also carried out.
Misused or forged tickets and subscriptions will be confiscated. Tickets and season tickets in use which are not suitable for use may be withdrawn by applying the same provisions. The user must pay a handling fee of CHF 100.00.
Civil or penal measures remain reserved.
2.4 Exchange/Refund
Tickets and season tickets cannot be subsequently exchanged for other tickets or season tickets. Refunds will only be made for compelling and unforeseeable reasons, such as accident o9r illness that demonstrably (doctor's certificate) makes further use of the season ticket (season and annual tickets and multi-day tickets) impossible. Accompanying relatives or acquaintances are not entitled to a refund. The medical certificate is decisive for the calculation of the refund amount. The season ticket must be returned to the issuing office within two weeks.
Calculation of the refund for season an annual passes in the case of season and annual passes, the refund is made in the form of a voucher, which is valid for 3 years from the date of issue. The voucher is personal and cannot be transferred to other persons.
- Return until 31.12.: 60% of the purchase price
- Return until 31.01.: 40% of the purchase price
- Return until 28.02.: 20% of the purchase price
Calculation of the refund for multi-day tickets
For multi-day tickets, the refund is calculated as follows:
When buying a 5-day ticket CHF 250.00
Accident after 3 days
= Deduction of a 3-day ticket CHF 159.00
Refund CHF 91.00
Operating restrictions or suspensions due to unfavorable weather (such as storm), opertional break-downs (such as power failure), etc. do not entitle to any Kind of refund, extension or compensation.
3. Exclusion from transport
3.1 General
Persons can be excluded from transport if they:
- are drunk or under the influence of narcotics;
- behave improperly;
- do not follwo the rules of use and conduct or the instructions
of the personnel based on those rules.
3.2 Transports for the practice of a sport
If the weather conditions are unsuitable for practicing sport, especially in the case of avalanche danger, persons can be excluded from trasport to practice the sport.
Furthermore, persons may be excluded from transport for the practice of a sport if they endanger third parties immediately before the intended transport and there is reason to believe that they will continue to endanger third parties. The ticket or Season ticket may be confiscated in the event of a recurrence or in serious cases.
A danger to third parties exists in particular if the Person concerned:
- has been reckless;
- has passed over an avalanche-prone slope;
- has disregarded instruction and prohibition signs that serve safety purposes;
- has not complied with the safety regulations of the supervisory and emergency services.
4. Liability
As far as permissible, the liability of the cable car company is limited to gross negligence and willful conduct. Please-ovserve the FIS rules (SKUS), Signs and barriers: You pass over areas which are off the marked and open pistes of the Hoch-Ybrig AG at you own risk. Outside the official operating hours of the cable care company the slopes are closed and no securd against any danger such as avalanche blasting or snow groomers. Caution danger to life! Guests who ski down avalanche-prone slopes and trigger avalanches in disregard of the warning signals are in breach of a secondary contractual obligation and are liable to the mountain railway company for any damage caused as a result.
Pleas note the times of the last slope controls. The ski patrol and rescue team monitors and controls only the marked and open slopes. The cable car company declines all and any liability.
5. Emergency service
If a guest has an accident on the Hoch-Ybrig AG area and the rescue service has to bi called out or the rescue station has to be visited, the guest will be charged a maximum of CHF 4800.00 plus material costs. Outside the marked and open pistes and outside the official operation hours, the costs will be charged to the guest at cost.
Third-party costs (e.g. Rega, doctor) will be invoiced directly by the third-party provider. Any claims for reimbursement must be made by the guest himsel to his insurance company.
6. Applicable law/Jurisdiction
The contract between the customer and Hoch-Ybrig AG is subject to Swiss law.
The place of jurisdiction is Unteriberg unless mandatory legal provisions stipulate a diffrente place of jurisdiction.
